Benevento. “Wall” of defense by Umberto, the decision of the judicial administrator.

Benevento. They had arrived to carry out the forced eviction of the villa in Benevento in which he, his wife, and daughter live. However, the operation has been postponed indefinitely due to the lack of a sufficient number of law enforcement officers, but above all due to the defensive “wall” that the judicial administrator, accompanied by two patrols of the finance police and the police, had to deal with.

This “wall” was erected by lawyers Marcello D’Auria and Matteo De Longis, who respectively assist Umberto Fiore, a 59-year-old accountant, and his spouse. He was released on October 28th after serving over 9 years for association with a camorra-type criminal organization: a conviction that arose from an investigation into the Pagnozzi clan.

A couple of weeks before the prison doors opened definitively, Fiore was the recipient of the seizure, aimed at confiscation, of three properties formally registered to foreign companies, based in the Principality of Monaco and the British Virgin Islands, but, according to investigators, attributable to him. A measure signed by the Rome Court – Section for the application of preventive measures – based on the investigations of the financial police in Benevento, according to which these assets would have been “disproportionate to the incomes declared by the 59-year-old, his family nucleus, and the companies formally registered as owners of the properties, and should be considered acquired, in the absence of any lawful income source, thanks to the proceeds of the illegal activities carried out by the recipient of the measure.”

Therefore, a seizure aimed at confiscation, for which, after the appearance hearing in November, the start of the procedure is scheduled for April next year. In the meantime, the defense has appealed to the Court of Cassation after the rejection by the Court: lawyer D’Auria, in particular, has requested that, pending the completion of the procedure at all levels of judgment, Fiore be allowed to continue living in that house since he does not have another one. The Supreme Court will have to pronounce, and the next step was the eviction order from the Rome Court for the wife, but not for the 59-year-old. This morning, there was a twist, with the execution being postponed after a long confrontation between the parties with a series of documents.
